Trademark Objection

Examination-report replies on absolute and relative grounds.

If the examiner objects — similar mark, descriptive word, missing formality — you have a limited time to reply. A good reply cites the difference in goods, the stylisation of the mark, or honest concurrent use. Missing the deadline can abandon the application. Send us the examination report as soon as it arrives.

Who this is for

  • Applicants who received an examination report
  • Founders whose mark was objected as descriptive or similar

Documents usually needed

  • Application number and the PDF of the report
  • Proof of use, if use is your best argument
  • Consent or coexistence material, if you have it

How Digital Filings handles it

  1. Read every objection, not only the similar-mark one.
  2. Draft the reply and the user affidavit if needed.
  3. File on the IP India portal and diary the next status check.

Timeline

The reply window is stated in the report, often 30 days. File early. The registry then takes its own time to accept or list a hearing.

Questions people ask

Can every objection be overcome?

No. A purely descriptive word with no acquired distinctiveness is hard. We will tell you if a fresh filing is wiser than a weak reply.
